Clifford Law Offices Files Complaint Against Trucking Company in Death of Bolingbrook Teenager
Press Release, 09/22/2006Clifford Law Offices today filed a lawsuit on behalf of the family of an 18-year-old girl who was killed as a passenger in the back seat of a car that hit a truck whose driver failed to yield. John T. Karnezis, partner at the firm, will ask the Cook County Circuit Court on Monday for a protective order to preserve the vehicles and records involved in the crash earlier this month.
The wrongful death lawsuit was filed on behalf of the family of Nayeli Murillo, a senior at Bolingbrook High School. She was traveling on Remington Boulevard near the school on the afternoon of Sept. 11 with two friends in the southwestern suburb when a truck driver of a semi-trailer cut in front of their car as the truck driver attempted to make a left hand turn out of an industrial park onto Remington. The teenagers’ car collided with the trailer then smashed into a tree, killing the car’s driver and two passengers.
The truck was operated by Intercon Cartage of Bedford Park. The driver, Scott Witt, 41, of Romeoville, was cited for failure to yield while turning left. Additional charges are pending review by the Will County State’s Attorney’s Office. Witt was not hurt in the crash.
"This is a real tragedy," Karnezis said. "The truck driver should have been particularly careful near a school, knowing that young drivers were in the area."
Two driver’s education teachers from the school were in the area and witnessed the crash. They called 911 and attempted to administer medical care at the scene before paramedics arrived.
Also killed in the crash was Murillo’s classmate, Luis Vega, 18, driver of the 2000 Nissan Maxima carrying the teenagers and a former student, Javier Moraira, 18, who was the front-seat passenger.
Nayeli Murillo, also a part-time employee of The Golden Corral restaurant, would have graduated in June. She had two brothers and a sister including Linda who also is a student at the high school.
