Motion Filed by Victim's Family in Comair Crash to Preserve Taxiways and Runway

Clifford Law Offices on Thurs., Sept. 14 appeared before the Lexington state court judge in the Comair crash on a Motion filed asking the court to direct the Lexington-Fayette Urban County Airport Authority and its Board to preserve the integrity of the scene of the crash. This includes preserving Runways 22 and 26 as well as the taxiways, signage, paint markings, striping and lighting at Blue Grass Airport in Lexington, Kentucky.

The Motion seeks a restraining order and/or a temporary injunction from Judge Pamela Goodwine. If granted, it would preserve the taxiways and runways in their current condition so as to allow experts and attorneys for the victims’ families to examine the surfaces as well as their configuration. The motion also seeks the issuance of an order permitting access to the scene or in the alternative the issuance of a subpoena to permit access to the scene by experts hired by attorneys for the victims of the crash of Comair Flight 5191. It has been reported that construction work at the airport had been taking place just prior to the crash that killed 49 people.

Robert A. Clifford and Michael S. Krzak, partners at Clifford Law Offices of Chicago, filed the Motion as attorney for Joshua Isaac Adams, administrator of the estate of his mother, Rebecca Adams, who died in the crash. Also filing the motion is Bobby Wombles and Chad Wadlington of Wombles & Wadlington of Lexington, Ky. They will appear before Judge Goodwine at the Kentucky State Courthouse at 120 North Limestone St. at 8:45 a.m. Thursday.

Earlier this month, Judge Goodwine entered a Protective Order directing Comair to preserve certain evidence including remnants of the wreckage and records relating to the crash, pilots, aircraft maintenance, training materials and other pertinent data.
