Clifford Law Offices Files Civil Lawsuit Against Waukegan Police in Stabbing Death of Mother Outside of Lincolnshire Restaurant
Press Release, 07/10/2008 Clifford Law Offices today (Thursday, July 10) filed a lawsuit against the city of Waukegan for its Police Department’s failure to protect a woman who was killed July 5 by her husband as she left a pancake house in Lincolnshire where she worked as a server.
Adelina Weber had obtained a court order of protection against her husband, Clarence Weber Jr. on May 5. Waukegan Police were in the family’s far north suburban home two months before he allegedly killed her when officers observed a note signed by Clarence Weber in big letters in the kitchen that read in part, “Now everything is going to end.”
The couple’s residence was destroyed by fire the next day which was reported to the Waukegan Fire Department as a possible arson. The house, though, was bulldozed several days later, destroying all of the contents of the home. For several weeks, Clarence Weber, in violation of the protection order, allegedly stalked his wife and ultimately went to his wife’s place of employment on July 5 and stabbed her to death in the restaurant parking lot.
Clifford Law Offices’ complaint alleges that the Waukegan Police Department and its Police Chief William Biang, also named as a defendant in the civil lawsuit, took no action to investigate her husband or to protect Adelina Weber. Under the Illinois Domestic Violence Act, the complaint alleges that the police had a duty to arrest Clarence Weber upon learning of a violation of the protection order and to arrange for Adelina’s transportation to a safe place.
The complaint also names Clarence Weber as a defendant. He has been previously convicted of attempted murder of his first wife, kidnapping of his eight-year-old daughter, and other serious criminal offenses including arson.
The complaint names Adelina’s sister-in-law, Cynthia Trujillo, as the Special Administrator of her estate. The couple’s three children are being cared for by Adelina’s relatives.
