Robert A. Clifford, founder and senior partner at Clifford Law Offices, authored an article for the Chicago Lawyer titled “Smart Development.” The article discusses that while recent innovations in medical AI are transforming the design, testing, and optimization of medical devices, challenges that can impact medical malpractice lawsuits remain.
AI in healthcare has the potential to aid medical technology such as imaging, diagnostics, and patient safety through its speed and efficiency in generating and evaluating algorithms. However, Mr. Clifford is skeptical about whether the FDA can stay ahead of the rapid new developments and ensure new technologies are in the best interest of patients.
“Despite the benefits of AI in medical device development, numerous challenges need to be addressed. Ethical considerations, such as patient privacy and data security, must be carefully addressed to ensure the responsible use of AI in healthcare.”
– Robert A. Clifford, founder and senior partner at Clifford Law Offices
Among his concerns, Mr. Clifford cautions medical malpractice lawyers that with the tremendous information growth AI will inevitably bring, it will be essential for the profession to remain invested in understanding the technology and maintaining the ability to recognize negligence to pursue liability.
