Two Major Law Firms Sue Allstate for Alleged Surveillance of Consumers

Morgan & Morgan and Clifford Law Offices have filed a class action lawsuit against Allstate Insurance for the alleged surveillance and invasion of privacy of more than 45 million Americans by collecting their data without prior consent.

The complaint alleges that Allstate developed software that could be integrated into third-party apps to secretly collect consumers’ driving behavior. The software was allegedly designed to harvest several types of data, such as geolocation, accelerometer, longitude, latitude, GPS time, speed, and accuracy. Once collected, the data was allegedly monetized in several ways, including selling the data to other insurance companies and using the data for Allstate’s own insurance underwriting and coverage decisions, allegedly unbeknownst to insureds, according to the 24-page complaint filed on January 14, 2025, in federal district court in Chicago.

A copy of the complaint is attached, and below is a joint statement from Morgan & Morgan founder John Morgan, Morgan & Morgan attorney John Yanchunis, and Robert A. Clifford, founder and senior partner of Clifford Law Offices in Chicago.

“Allstate has allegedly built the ‘world’s largest driver database’ by collecting and selling data about tens of millions of people without their consent. Our class action lawsuit alleges that Allstate undertook this data collection effort to increase its profits at the expense of unaware consumers and their privacy. We are fighting on behalf of our clients to put a stop to this purportedly improper data collection and hold Allstate accountable for its alleged surveillance and invasion of privacy.”
